1. Information We Collect
We collect and use the information below to provide, understand, and improve our Services.
1.1 Information You Provide to Us
Registration Information: When you register for a Hytch Rewards account, you provide to us your name, email address, and mobile or “cellular” phone number.
1.1.1 User Profile Information: When you join the Hytch community of Users (“Users”), you opt-in to share your location services (GPS coordinates, also “location information”). You may update your access settings at anytime from your device settings. If you opt out of allowing Hytch access to location information, the reward platform will not function. Location information could be used to deliver proximity based advertising.
As a User, you also contribute your status (ie. in ride, host, driver, rider, or using public transit or ride-hail service), along with who you are riding with (“paired”). Your phone contacts (phone address book) are linked to the app locally on your phone to make it easier for you to send ride invitations. Only contacts that have been invited to use Hytch will be collected by Hytch. Your name, names of paired riders or drivers, and associated groups are always part of your Profile. You may also choose to complete a survey or fill out an advanced Profile including, but not limited to, date of birth, address or zip code, income range, marital status, occupation, and interests. This information also becomes part of your Profile.
1.1.2 Communications: If you contact us directly, we may receive additional information about you. For example, when you contact our Customer Support Team, we will receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. If you join one of our Hytch Community Facebook group, we will receive additional information publicly visible on your Facebook profile and the contents of a message or attachments shared in the group discussion or post.
1.2 Information We Collect When You Use Hytch
1.2.1 Location Information: Hytch is about rewarding people who share rides. To do this, we need to validate your shared miles by tracking your GPS coordinates. When you open the Hytch Rewards app (“app”) on your mobile device, we receive your location. We may collect the precise location of your device when the app is running in the foreground or background.
You can choose to share location services information “Always” or “Only While the App is in Use.” If you share permission “Always” through your device settings or app, we may collect your location while the app is closed in order to identify promotions or service updates in your area. Your location information is necessary for determining starting locations, ending locations and routes that are eligible for rewards, identifying the proximity of other riders to you in a shared ride, and tracking your mileage for rewards purposes.
1.2.2 Device Bluetooth-related location and surroundings data. If your device settings have Bluetooth enabled, then we may detect Bluetooth devices such as beacons around your device and their signal strength. Many public locations have installed such Bluetooth devices. If you disable Bluetooth and any Bluetooth scanning option in location settings in your device settings, your device will not send Bluetooth data to us. Disabling Bluetooth data may disqualify you from receiving some rewards and limit the app experience.
1.2.3 Device Information: Hytch receives information from User devices, including IP address, web browser type, mobile operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens. We collect mobile sensor data from User devices (such as location, speed, direction, GPS coordinates, wifi triangulation, elevation, acceleration or deceleration) to understand location accuracy and analyze usage patterns for improved Services.
1.2.4 Usage Information: To help us understand how you use the app, and to help us improve it, we automatically receive information about your interactions with Hytch, like the in-app tabs, website pages, or other content you view, your actions of use within the app, and the dates and times of your visit and participation.
1.2.5 Text Information: We work with a third party partner to facilitate text messages (“SMS”) to Users who sign up to use the app. We receive information about these communications including the date and time of the SMS message, the parties’ phone numbers, and the content of any SMS messages. Standard message and data rates may apply.
1.2.7 Information from Cookies and Similar Technologies: We may collect information through the use of “cookies”, tracking pixels, and similar technologies to understand how you navigate through the Hytch website and interact with Hytch advertisements, to learn what content is popular, and to save your preferences.
Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the Hytch website. You should consult your web browser(s) to modify your cookie settings. Please note that if you delete or choose not to accept cookies from us, you may miss out on certain features of the Hytch website.
1.3 Information We Collect from Third Parties
1.3.1 Third Party Services: If you choose to register for Hytch partnership offerings or otherwise link your Hytch account with a third party’s service, we may receive the same type of information from those services as we collect from you directly (described above).
1.3.2 Third Party Partners: We may receive additional information about you, such as demographic data, payment information, survey responses, or fraud detection information from third party partners and combine it with other information that we have about you.
1.3.3 Sponsor Programs: If a company, university, or any organization participates in one of our Sponsor Programs we may receive information about you, such as your email address or your unique employer ID from participating organizations, as necessary to direct specific rewards and distribute incentives as intended. A participating organization may invite you into a shared ride or offer incentives, in which case they may provide us with your name, phone number, and the pickup and drop off location for your ride.
2. How We Use the Information We Collect
We use the information we collect from all Users to:
Reward you for qualified rides;
Celebrate your environmental impact through carbon offset (“Trees Saved”);
Provide, improve, expand, and promote the Hytch Rewards Platform;
Analyze how the Hytch community of Users interact on the Hytch Rewards Platform;
Connect you to other Users to invite them to Hytch with you and validate shared rides;
Communicate with you, either directly or through one of our partners, for reasons including marketing and promotional purposes;
Personalize the Hytch experience for you and your friends and contacts;
Send you text messages and push notifications;
Facilitate reward payouts;
Provide you with customer support;
3. How We Share the Information We Collect
We do not disclose your private personal information. In the limited circumstances described below your participation can be shared as follows.
3.1 Sharing Between Users
3.1.1 Sharing Between Users: In the case that you invite and/or join a shared ride to be logged by Hytch, when you opt in to connect with Users or a participating transit asset (bus, train, etc..) in any way through the app, other Users may see basic information about each other, including name and status (such as pending, accepted or in-ride status).
While a cell phone number is used to connect to other Users, phone numbers are not disclosed through the app to other participants. Only the host of the Hytch invitation would know the cell phone number to each participant. In all cases, Users voluntarily disclose their phone numbers.
3.2 Sharing Between Hytch and Third Parties
3.2.1 API and Integration Partners: If you connect to the app through an integration with a third party service, we may share information about your use of the app with that third party. We may share your information with our third party partners in order to receive additional information about you. We may also share your information with third party partners to create offers that may be of interest to you.
3.2.3 Group Code Partners: If you enter a valid Group Code on your Profile, you may participate in an Employer Partner incentive or Sponsor reward program created to benefit members of that group. Trips that qualify for that Group reward earn incentives. To prove that an incentive was earned, your qualified trip data is shared to Group Code sponsoring organization. This does not include who you shared the ride with, unless the other User is also a Group Code qualified User. Data shared is limited to your start or end ride location, total distance of ride, name, date and time of use, points earned, transit asset type and/or vehicle information (if known) and location information, as necessary to qualify you for the Group Code reward. Your Group Code may be automatically terminated and benefits suspended if you leave the sponsoring organization’s program. Users manually enter their Group Code in their Profile, which can be updated or deleted by the User at any time.
3.2.4 Compulsory Sharing: We may share your information with other third parties when compelled to do so, such as in the following cases:
If a government authority requests information and disclosure is required or appropriate in order to comply with laws, regulations, or a legal process;
With law enforcement officials, government authorities, or third parties if we think doing so is necessary to protect the rights, property, or safety of the Hytch community of Users, Hytch LLC, or the public;
To comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures;
With our insurance partners to determine and provide relevant coverage in the event of an incident;
To provide information about the use of the Hytch Rewards Platform to potential business partners in aggregated or anonymous form, which can not reasonably be used to identify you;
While negotiating or in relation to a change of corporate control such as a restructuring, merger or sale of our assets; and
Whenever you consent to the sharing.
4. Your Consent Choices
4.1.1 Email Communication. A valid email address is required for your use of and participation in the Hytch Platform. You can always unsubscribe from our commercial or promotional emails. Continued participation in the Hytch Platform constitutes consent for Hytch to send any and all necessary transactional emails about your account activity, security, etc.
4.1.2 Text Message Communication. A valid mobile phone number is required for your use of and participation in the Hytch Platform. You can opt out of receiving commercial or promotional text messages by texting the word STOP to the text number associated with the messages. Note that texting STOP to the SMS service used by Hytch will disable the app from sending you Invitation texts from other Users, and prohibit you from receiving the Authorization Code necessary to set up your User Profile. This action may prevent you from using the app properly and may disqualify you from participating in Hytch Rewards..
4.1.3 Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications will negatively impact your user experience with the Hytch Platform (such as receiving a notification that you are invited to share a ride, or that your shared ride has ended and details of any rewards earned).
4.1.4 Phone Calls: In the case that you cannot be reached by email, you may be contacted by authorized Hytch representatives via the mobile phone number associated with your account.
4.1.5 Profile Information. While your name will always be shared with fellow Users, you can at any tie delete any additional information that you have voluntarily added to your Profile. Only your name, mobile phone number and email are required to set up a Profile on the Platform.
4.1.6 Location Information. While you can prevent your device from sharing location information at any time through your device settings, it is location sharing itself that is core to the function of the Hytch Rewards Platform. Hytch cannot validate and reward you (or the other User) for your shared miles without location services permission given by all Users. At minimum, your location service permissions of “Only While the App is in Use” is required.
5.1.1 Data Security: We are committed to protecting the data of the Hytch community of Users. Even though we take reasonable precautions to protect your data, no security measures can be 100% secure, and we cannot guarantee the security of your data.
5.1.2 Child Privacy: Hytch Rewards requires the “pairing” of at least two Users above the age of 13, or the pairing of any school aged User who is engaged with a Hytch sponsored bus beacon for the School Bus Ridership rewards program. Marketplace rewards earned by Users of Hytch Rewards are not intended for children under legal driving age in their state of residence. Hytch sponsored School Bus Ridership Reward programs, are intended specifically for school aged children who choose to use the school bus service. The School Bus Ridership reward program is authorized by the participating School District and specifically identify the school bus in the pairing, instead of pairing individual Users. We do not share any personal information (like phone numbers or names) with Sponsors or between Users in the School Bus Ridership reward program.
We do not knowingly collect personal information from children under the age of 13. If we find out that a child under the age of 13 has provided us with personal information, we will take steps to delete that information.
